Agreement to Terms

By accessing or using CaptureCall's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Description of Service

CaptureCall provides an automated dispatch system that helps home service professionals capture missed calls through SMS automation and AI-powered customer intake. Our services include:

  • Automated SMS responses to missed calls
  • AI-powered customer information collection
  • Dispatch alert notifications
  • Integration with phone systems and CRMs

Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Be at least 18 years old and legally able to enter into contracts
  • Accept responsibility for all activity under your account

Subscription and Billing

Subscription Plans: We offer monthly subscription plans as described on our pricing page. Your subscription automatically renews each billing cycle unless cancelled.

Payment: You agree to pay all fees associated with your subscription. We accept credit cards and ACH transfers. All fees are in USD and non-refundable except as required by law.

Price Changes: We may change our prices with 30 days' notice. Continued use after price changes constitutes acceptance of the new prices.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose or in violation of any laws
  • Send spam, unsolicited messages, or violate anti-spam laws
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service or servers
  • Impersonate any person or entity
  • Upload viruses or malicious code
  • Scrape or harvest data from our service

Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the service at any time with reasonable notice.

Intellectual Property

All content, features, and functionality of our service are owned by CaptureCall and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our service.

Customer Data

You retain all rights to your customer data. We process this data only as necessary to provide our services. See our Privacy Policy for details on data handling.

Disclaimer of Warranties

OUR SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTURECALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR GOODWILL.

Indemnification

You agree to indemnify and hold CaptureCall harmless from any claims, damages, or expenses arising from your use of the service or violation of these terms.

Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law provisions.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance.
